1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of www.loveguides.us and our coaching programs, sessions, materials, and related services (collectively, the “Services”). By accessing our website, scheduling a call, enrolling, or paying, you agree to these Terms.

2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms.

3. Nature of Services (Not Therapy)
We provide educational and coaching services only. We are not licensed therapists, medical professionals, attorneys, or financial advisors. Our Services are not a substitute for therapy, medical treatment, legal, tax, or financial advice. Always seek the advice of qualified professionals regarding any questions or conditions.

4. Enrollment, Fees, and Payment
Program fees are disclosed at the time of enrollment. Payment is due as stated at checkout or in your invoice. We accept payments via Square, Stripe, or PayPal. You agree to provide accurate billing information and authorize us (and our payment processors) to charge your payment method for the agreed amounts.

5. 30-Day Satisfaction Guarantee & Refunds
We offer a 100% money-back guarantee during the first 30 days of your program. To qualify, you must participate in good faith and complete the required steps/tasks during that period. If you are not satisfied, email info@loveguides.us within 30 days of your start date and include reasonable proof of participation. Approved refunds are returned to the original payment method.

6. Scheduling, Cancellations, and No-Shows
We respect your time and ours. If you need to reschedule a session, please do so at least 24 hours in advance using the scheduling link provided or by contacting us. Missed sessions or cancellations with less than 24 hours’ notice may be forfeited at our discretion.

7. Client Responsibilities
Your results depend on your engagement. You agree to: (a) attend sessions on time; (b) complete practices and assignments; (c) communicate honestly; and (d) maintain a respectful environment for
group and 1:1 work.

8. Communications Consent (Email, SMS, and Calls)
By providing your contact information, you consent to receive program-related communications from us, which may include email, SMS/text, and occasional reminder calls for appointments. You may opt out of marketing messages at any time (unsubscribe in email or reply STOP to SMS). Standard message and data rates may apply. We do not use robocalls or prerecorded promotional messages.

9. Intellectual Property
All program content, videos, workbooks, frameworks, and materials provided or made available by us are owned by Loving Presence Embodiment and are for your personal, non-commercial use only. You may not copy, share, distribute, record, or create derivative works without our prior written consent.

10. Confidentiality
We respect your privacy. Information shared in private sessions is treated as confidential except as required by law or where there is a reasonable concern of harm to self or others. For group settings, we encourage mutual confidentiality but cannot guarantee other participants’ actions.

11. Testimonials and Social Proof
If you voluntarily share feedback, testimonials, or results with us (e.g., via email or surveys), you grant us a non-exclusive license to use them for marketing in any media, using first name/initials only unless you give explicit permission to use your full name or likeness.

12. Website Use & Third-Party Links
Our website and materials are provided for informational and educational purposes. We may reference or link to third-party resources; we are not responsible for their content or practices. Do not misuse the website (e.g., introduce malware, attempt to scrape/copy content, or disrupt functionality).

13. Disclaimers (No Guarantees)
We do not guarantee any particular outcome or result. Your experience will vary based on many factors, including your participation, personal circumstances, and external conditions. THE SERVICES AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

14. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of profits, data, or goodwill). Our total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us for the program giving rise to the claim.

15. Indemnification
You agree to indemnify and hold harmless Loving Presence Embodiment and our team from any claims, losses, or damages arising from your breach of these Terms, your misuse of the Services, or your violation of applicable law.

16A. Governing Law & Venue (California; Court Option)
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any claim or dispute that is not subject to small-claims court shall be brought exclusively in the state or federal courts located in Alameda County, California, and you consent to their jurisdiction and venue.

16B. Governing Law & Dispute Resolution (Binding Arbitration Option)
Alternatively, if we adopt binding arbitration, disputes will be resolved under the laws of California through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Alameda County, California (or virtually, if agreed). Each party bears its own legal fees. The arbitrator’s decision is final and may be entered in any court of competent jurisdiction. No class or representative actions are permitted. Either party may still bring an eligible claim in small-claims court in Alameda County.

17. Changes to Terms
We may update these Terms periodically. Updates are effective upon posting on www.loveguides.us. Your continued use of the Services after changes are posted constitutes acceptance.

18. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Loving Presence Embodiment regarding the Services and supersede all prior discussions or understandings.
